Bio-Pharma: Novartis to Pay $347MM due to Violation of FCPA Novartis, a global bio-pharmaceutical manufacturer agreed to pay US$347MM as settlement for violations of the Foreign Corrupt Practices Act (FCPA). The U.S. Department of Justice (DOJ) and the U.S. Securities and Exchange Commission (SEC) investigated Novartis’ wrongdoing, alleging that it provided “improper benefits” to foreign doctors to boost sales of the company’s products in South Korea, Vietnam, Greece and China. DOJ Assistant Attorney General Brian Benczkowski said the drugmaker "profited from bribes that induced medical professionals, hospitals, and clinics to prescribe Novartis-branded pharmaceuticals...and they falsified their books and records to conceal those bribes.” It is important for drugmakers to be aware that regulatory compliance standards in one country may apply to transactions in another. International Economy: World Bank Debars South Korean Company for Fraud
The World Bank has debarred Yooshin Engineering Corporation for 13 months, stating Yooshin fraudulently failed to disclose the unavailability of key experts for the Vanuatu Aviation Investment Project. The USD60MM project was to improve the operational safety and oversight of international air transport and associated infrastructure in Vanuatu.
Asacondition of the settlement, Yooshin acknowledged responsibility and took voluntary remedial actions, agreeing to develop an integrity compliance program and cooperate with the World Bank Group Integrity Vice Presidency. After the thirteen-month debarment, Yooshin is subject to seventeen months of conditional non-debarment. Whether intentional or not, non-compliance can have serious financial and reputational consequences. Blockchain Technology: Merck, Walmart, IBM & KPMG Completes FDA’s Blockchain Pilot
IBM, KPMG LLP, Merck & Co. Inc., and Walmart Inc. successfully completed an FDA pilot program that demonstrated how blockchain technology can be used to help meet the Drug Supply Chain Security Act (DSCSA) requirements to verify, track, and trace prescription medicines and vaccines distributed within the United States. With the amount of data and number of participants involved in tracking and tracing medications throughout the supply chain, the pilot showed that blockchain can connect disparate IT systems and different organizations to have a common view of product traceability in the market.
An additional benefit uncovered was that blockchain technology can reduce the time it takes to alert the supply chain of a product recall from a few days to a few seconds. This enhanced communication identifies specific product within a supply chain network and removes them before they can be dispensed.
